Traditionally, the law of the sea was divided into the territorial sea and the high seas which accounted for the application of different rules under different circumstances. Concerning the territorial sea, the coastal state enjoys full sovereignty to the right of innocent passage, while under the high seas rules all countries enjoy multifaceted uses of the sea qualified only by the limitations imposed by international law. The development of the exclusive economic zone ended this traditional dualism and ushered in guidelines that are embodied within the text of the LOS Convention. The Exclusive Economic Zone presents to academia and the general reading public a comprehensive study of the EEZ concept as it relates to the LOS Convention and state practice. The Exclusive Economic Zone shows that even through coastal states have the right to develop a 200 miles EEZ and that this right is an integral part of contemporary international relations, it is also true that the EEZ concept is shrouded in legal ambiguities. The state created a corporate fiction which is a separate legal entity and distinctive from the shareholders and which offers the primary advantage of limited share-holder liability. The underlying notion is to encourage shareholders to provide capital and take on risky investments. In this way, the risk is shifted towards third parties and costs are external-ized. Overall, this investor attitude encourages economic development. Hence, limited liability can be seen as the "cornerstone of capitalism". However, as moral hazard comes into play, the externalization costs might exceed the benefits and, thus, damage third parties. In order to pro-mote justice, the presumption of limited liability must be occasionally rebutted and personal li-ability imposed on shareholders. Scholarly opinions have therefore developed different theories. Some want to reduce the application to a minimum, the international ius cogens, whereas others argue that international law should prevail in all cases over the host state's law. Some authors as well as the case-law also establish different limits. This paper analyses the role of international law with many different interpretative methods from civil law and common law. It concludes that no artificial limits can be maintained, but the current version of Article 42(1) leaves the determination of the scope of international law to the discretion of the tribunal. In order to clarify the notion entirely, more harmonisation of the substantive rules on foreign investment would be needed, either on the national or on the international level. Today, the general wisdom is that the state should completely recede and that private ownership of the means of production is the only viable approach to efficient production of goods and services, economic growth and development. However, the same factors that led to the collapse of the public enterprises are also afflicting the privatisation exercise. In this paper, the practice of privatisation meant to promote private means of ownership and in turn increase the production capacity of every sector is critically examined. Focusing on the wave and sad experience of privatisation in a period of 2000-2012 which was riddled with corruption, nepotism, lack of good corporate governance and incompetent manpower in the country, the paper concludes that total privatisation of every sector will never solve the economic impasse of Nigeria.

Even though inequality is driven by many different factors, this paper attempts to analyze whether BEE was able to effectively reduce inequality in the way that it was intended. My findings suggest that BEE might have helped to reduce inequality between different races, but that it increased inequality among black people.During Apartheid, black people were excluded from major parts of South Africa's economy. This resulted in an unequal income distribution in South Africa. Even after Apartheid ended in 1994 income was distributed unequally between races. In order to reduce this inequality and equalize opportunities between the different races in South Africa, the government implemented an affirmative action program called Black Economic Empowerment (BEE) in 2003.
